  1. WEZMART TECHLAB SDN BHD (hereinafter referred to as “we”, “us”, “our”) values your privacy and is committed to safeguarding your personal data in compliance with the laws of Malaysia.

As the ‘data controller’, we will only collect, process and use your personal data in accordance with all applicable laws and regulation (including but not limited to the Personal Data Protection Act 2010 and any amendments thereto), this Privacy Notice and any other privacy terms in your agreement(s) with us.

What kind of personal data we collect and the method/how we collect it

  1. When you access the bpoSA360, we may need to process (i.e. collect, hold, record, use and/or disclose) your personal data, which includes any data which relates directly or indirectly to you and/or your clients. Such personal data includes, but is not limited to your name, your client’s company information, address, financial data, business information captured by the software, the information contained in any of the application forms whether you have filled up at our office or at our website and any such other necessary data regarding yourself and your transaction with us (“Personal Data”).
  2. We may obtain your Personal Data from a variety of sources, including but not limited to:
    (a) through your relationship with us, for example information provided by you in the application form, when taking part in our customer survey, competitions, and promotions;
    (b) through your verbal and written communication with us/and or authorized representatives; and
    (c) from third parties connected with you such as your client, agent an employee where you have given your consent to disclose your Personal Data to us.

Purpose of Processing

  1. We may use and process your Personal Data for any one or more of the following purposes listed below, including but not limited to:
    (a) Facilitating for the use of the bpoSA360;
    (b) to correspond with you via any electronic communication and/or any other appropriate communication channels available at the relevant time;
    (c) for administrative purposes;
    (d) to market and promote the bpoSA360 that may be of interest to you from time to time via any electronic communication and/or any other appropriate communication channels available, subject to your consent;
    (e) other purposes which we may reasonably deem fit and/or other purposes that may be set out in the document(s) that are related or relevant to you;
    (f) to comply with any legal or regulatory requirements, including laws, regulations, guidelines, or directives issued by governmental authorities and/or courts of competent jurisdiction pertaining to bpoSA360.
  2. The failure to obtain your Personal Data may result in the following:
    (a) we will not be able to process your application or request;
    (b) we will not be able to provide you the access of bpoSA360 or other services requested by you; and
    (c) We will not be able to notify you about updates or changes to bpoSA360 or our services

Parties to Whom We May Disclose your Personal Data

  1. We may disclose with and/or transfer your Personal Data to the following parties:
    (a) Companies and/or organization within Us;
    (b) companies and/or organizations that act as our agents and/or professional advisers;
    (c) companies and/or organisatios to whom we have outsourced the performance of operational functions to assist us in processing and, administering of the bpoSA360.
    (d) any personnel under a duty of confidentiality to Us;
    (e) any court, tribunal or authority, whether governmental or otherwise, with jurisdiction over us. Whether in or outside Malaysia for any of the purposes set out above.
  2. We will otherwise treat your Personal Data as private and confidential apart from the parties stated above and we will not disclose your data to any other party except:
    (a) where you have given consent;
    (b) where we required or permitted to do so by law;
    (c) where required or authorized by any order of court;
    (d) where we may transfer rights and obligations under your agreement(s) with us; and/or
    (e) where we are required to meet our obligations to any relevant regulatory authority.

Security of your Personal Data

  1. We recognize that your information is valuable, and we take all reasonable measures to protect your Personal Data from loss, misuse, unauthorized access, disclosure, alteration, or destruction.

Retention of your Personal data

  1. We will retain your Personal Data in compliance with this Privacy Notice and/or the terms and conditions of your agreement(s) with us for the duration of your relationship with us, , and until the termination or end of the agreement (if any) or terms of use with you, or for such period as may be necessary to protect our interests.
  2. We will, within a reasonable time, take such steps and processes to remove, delete, destroy and/or cancel your Personal Data upon expiration of the applicable retention period.

Your Right to Access and Correct your Personal Data

  1. You have the right to access and correct your Personal Data held by us. If you believe that your Personal Data is inaccurate, incomplete, misleading, or not up-to-date, you may make a request to correct or update it.
  2. To request access to or correction of your Personal Data, please contact us via email at [insert email address]. We will endeavor to comply with your request within 21 days upon receiving your email and any applicable processing fee (if applicable).
  3. Please note that we may have to withhold access to your personal data in certain situations, for example when we are unable to confirm your identity or where the data requested for is of a confidential commercial nature or in the event, we receive repeated requests for the same data.
  4. Nevertheless, we will notify you of the reasons for not being able to accede to your request. Please also note that we may exercise our discretion in allowing the corrections requested and/or may require further documentary evidence of the new data to avoid fraud and inaccuracy.

Data Breach Notification (Notification)

  1. In the event of a data breach that affects your Personal Data, we are committed to taking immediate action to assess and mitigate the impact of the breach. We will notify you without undue delay if we believe that your Personal data has been compromised and poses a risk to your rights and freedoms.
  2. Should a data breach occur:
    (a) we will promptly investigate the breach to determine the nature and scope of the incident.
    (b) we will take immediate measures to contain the breach and prevent any further unauthorized access or damage.
    (c) if the breach is likely to result in a high risk to your rights and freedoms, we will notify you via the contact information you have provided. This notification will include:
    (i) A description of the nature of the breach.
    (ii) The categories and approximate number of the Personal Data records involved.
    (iii) The likely consequences of the breach.
    (iv) The measures taken or proposed to address the breach, including any measures to mitigate its possible adverse effects.
    (d) We will notify the Personal Data Protection Commissioner (“Commissioner”) in the manner and form as determined by the Commissioner.

Revision to privacy notice (Revision)

  1. This Privacy Notice may be revised from time to time. Notice of such revision will be given by such means of communication deemed suitable by us.
